Navigating collaboration and competition in EU markets
Kathrine Søs Jacobsen Cesko is an Assistant Professor in Competition Law and Public Procurement Law at Copenhagen Business School.
Kathrine’s research lies at the intersection of EU competition law and EU public procurement law, with a particular emphasis on collaborative bidding arrangements. She combines doctrinal legal analysis with economic insights to address complex issues in both established and emerging markets.
In 2022, Kathrine was awarded her PhD for her thesis Collaboration between Economic Operators in the Competition for Public Contracts: A Legal and Economic Analysis of Grey Zones between EU Public Procurement Law and EU Competition Law. The thesis examines collaborations between economic operators in meeting the requirements of public contracts, including reliance on the capacities of other entities, the formation of bidding consortia, and subcontracting arrangements. Kathrine analysed these collaboration types in depth, assessing their legal and economic dimensions under both public procurement law and competition law, and evaluating when they may be permissible or problematic within a competitive framework.
Kathrine is also co-founder and co-director of the Copenhagen Competition Law Lab, a strategic partnership between leading competition law researchers and practitioners. The Lab aims to establish a strong platform for research and debate on competition law from Danish, EU, and economic perspectives, fostering interdisciplinary dialogue and connecting academic insights with practical developments in the field.
Furthermore, Kathrine has a research interest in digital markets. She served as one of Denmark’s national rapporteurs for the FIDE report on the EU Digital Economy, focusing on the general framework of the Digital Services Act (DSA), the Digital Markets Act (DMA), and specialised regulatory regimes.
