New op-ed in Bloom­berg Law on AI Gover­nan­ce and Role of Fo­un­da­tions

A re­cent Bloom­berg Law op-ed uses the Pen­ta­gon dis­pu­te in­vol­ving Ant­hro­pic and Ope­nAI to show why or­ga­niza­tio­nal de­sign mat­ters for AI com­pa­nies.

The authors Mark Ørberg and Ofer Eldar point out that OpenAI’s revised structure increasingly resembles well‑known European enterprise foundations, where a nonprofit foundation controls a profit‑seeking company and uses distributions to fund charitable activities.

The article contrasts this model with Anthropic’s more mission‑centred governance and argues that these structural differences shape how AI firms balance safety, commercial strategy, and public responsibility—especially in sensitive areas such as national security. The case highlights how foundation ownership can enable both long‑term mission control and greater strategic flexibility.
