Law@CBS Workshop: is it an unfair commercial practice to mislead vulnerable consumers?

This presentation addresses possible application of behavioural economics in the assessment of commercial practices regulated in the Unfair Commercial Practices Directive. The Directive introduces full harmonisation of business-to-consumer commercial practices with a view to protect consumers’ economic interests by prohibiting unfair commercial practices. The presentation focuses on situations where consumers may have their economic behaviour distorted by commercial practices that are lawful under the Directive, and how the protection in the Directive may be tweaked to protect more vulnerable ('less sophisticated') consumers. In the seminar, Jan Trzaskowski will also suggest how his research can be applied for an overall law & behavioural economics analysis of the EU consumer law acquis.

Jan Trzaskowski is Associate Professor at the Law Department, Copenhagen Business School. He specializes in consumer law with particular focus on marketing and electronic commerce.
