New research by Mark Ørberg on foundations and foundation law

Assistant Professor Mark Ørberg has published an article on discrimination on the basis of age in Danish enterprise foundations, showing empirically the current level of discrimination and how EU law has significant influence in matters previously thought to be outside the scope of EU law. The article – published in Ugeskrift for Retsvæsen U2023.38 – is the first to analyze the June 2022 CJEU case on age limits (C-587/20).

Addtionally, Mark presented his research on foundations at the Foundation Conference in Copenhagen on 18 April. In this presentation, Mark specifically focused on equal distribution purposes and considered signs of development on the subject in recent authority practices. Additionally, he sketched out the most important and possibly slightly underestimated opportunities for increased flexibility by e.g. extending the fund purpose to include environmental and sustainable purposes or other broad categories of purposes. You can read more about the conference here.
