Marie-Louise Holle, Associate Professor at CBS LAW MPP, and Amalie Bang, Deputy Judge at the Maritime and Commercial High Court of Denmark, have published an article entitled ‘Making Legal History: State Liability for Negligence in Climate Change’. 

From a public international law (human rights) and tort law perspective, the article provides an analysis of a recent yet already internationally famous and much debated judgment: A claim from the NGO Urgenda was brought against the Dutch government for failing to comply with the duty of care in order to take adequate measures of mitigation against climate change.

The article is published in European Public Law, which is on the MPP list of journals (EPL Vol. 26, No. 1, 2020, p. 45-57)
