Seminar: Judicial Activism at the ECJ: An Empirical Assessment (18-3-11)
Iyiola Solanke will present a paper on the extent to which the European Court of Justice can still be considered a monolithic institution with ´runaway´ potential. Using a sociolegal analysis the paper uses empirical data gathered during interviews with the ECJ's Advocates General in order to disaggregate the ECJ and gain an understanding of activism within it. She concludes that the court cannot be considered an activist institution per se and that consequently understandings of its decisions need to be less unitary and more nuanced.

Positive Action and Sex Discrimination at Danish Universities: Making Sense of the Current Debate (2-12-10)
Lynn Roseberry, Associate Professor and Head of the Law Department, will explain why such positive action measures are permitted by Danish and EU law, and Niels Balslev Wendelboe, Vicedirektør, University of Copenhagen will explain how University of Copenhagen made its decision to adopt this kind of positive action measure and how it has worked so far.

Conference: European Legal Method (19-11-10)
The conference is part of the project Towards a European Legal Method: Synthesis or Fragmentation
. The project examines the extent to which it is possible to identify a coherent legal method (doctrine of the sources of law and their interpretation) that may be applied when analysing EU law and the law of EU Member States within the scope of application of EU law. It looks at what characterises the sources of law and the interpretation methods that are actually used by European legal actors, especially judges and researchers, when analysing what is valid law. It examines the changes in the relative importance of various sources of law that occur in connection with the integration of EU law into national law.

Genstandsfeltet for Peter Koerver Schmidts afhandling er den delmængde af skatteretlige værnsregler, der har til formål at imødegå, at selskaber - som led i international skatteplanlægning - flytter mobile aktiver og indkomststrømme til jurisdiktioner, hvor de lokale regler indebærer en mere gunstig eller eventuelt ingen beskatning. Med andre ord skal afhandlingen have fokus på regler til værn af indkomstopgørelsens positive indkomstkomponenter.

Seminar: Discrimination bans and the social psychology of oppression: Is current anti-discrimination law an effective way of dealing with social inequality? (25-5-10)
Speaker: Lynn Roseberry, Law Department - CBS.
In the EU, anti-discrimination law has granted the most protection against discrimination based on race and sex while the other prohibited grounds of discrimination have received less protection. This differentiation in protection resembles a pattern established in American anti-discrimination law, which American legal scholar Kenji Yoshino has called the "assimilationist paradigm". The essence of this paradigm is a requirement that proof of discrimination requires showing that the claimant is physically unable to assimilate to the allegedly discriminatory norm applied to him or her. I will argue that the assimilationist paradigm is based on a liberal theory of the self that does not correspond to modern psychological theories of identity formation and social oppression and that it is inherently ineffective in redressing many cases of discrimination. I will provide examples from European and American case law showing that this requirement is especially difficult to fulfil in cases of gender, sexual orientation, racial, ethnic and religious discrimination and explore the usefulness of alternative theories of identity in providing a better approach in these cases.

Seminar: LRAIC-prismodellen i dansk teleret (1-12-09)
LRAIC-modellen, eller måske nærmere modellerne, er komplicerede modeller, der ikke blot indeholder et stort antal beregninger, men tillige forskellige former for skøn, antagelser og målsætninger. Formålet med seminaret er at få belyst disse implicitte antagelser m.v., der nærmere normerer opbygningen af den danske LRAIC-fastnetmodel. Udover at gennemgå processen frem til "endelig" implementering, vil seminaret bl.a. fokusere på LRAIC'ens baggrund, opbygning samt implicitte antagelser.
